WHY IS THE KUALA LUMPUR CITY HALL (DBKL) SO DEFENSIVE OF YARL RESTAURANT'S FAULTY KITCHEN HOOD?


The video above  is taken at 5.40 a.m. this Sunday morning (25 May 2014). I was actually still sleeping soundly at that time when I suddenly heard a loud blasting sound in my dream. I was waken up suddenly only to find that yarl restaurant has turned on it's loud and thunderous kitchen hood again at 5.40 a.m. This video can also be viewed at http://www.youtube.com/watch?v=hk_cxisl7RA&feature=youtu.be. In this video, you can see yarl restaurant's open air kitchen very clearly. You can also see yarl restaurant's faulty kitchen hood. (The thing with the telephone number on it is yarl restaurant's faulty kitchen hood). 

Does yarl restaurant have the right to chase everyone out of their bedrooms at 5.40 a.m. in the morning, particularly on Sunday mornings? It seems that with the support given by the Kuala Lumpur City Hall (DBKL)'s Thilagenthiran a/l Somasundram, there isn't anything which yarl restaurant cannot do. Since yarl restaurant has already chased me out of my bedroom when I should be sleeping at this hour of the day, I might as well write this article. After all, what should I do when I feel so sleepy and tired now but cannot sleep because of the kitchen hood noise? My question for today is "Why is the Kuala Lumpur City Hall (DBKL)'s Thilagenthiran a/l Somasundram telling fishy lies and doing fishy things to cover up for yarl restaurant? 

In actual fact, yarl restaurant's air and noise pollution program is a chronic problem which cannot be solved by the Kuala Lumpur City Hall (DBKL). Why is it so? According to the DBKL, it is not their problem as they are only dealing with licensing. They asked me to call the Department of Environment (DOE) but the DOE said that this is not their jurisdiction. They kicked the case back to the DBKL. Yarl restaurant's air and noise pollution case is like a football that is being kicked from one department to another. (Is this an indication of our government departments' poor services and/or laziness on the part of our civil servants? If that is the case, the Goods and Services Tax, GST, should be abolished as it cannot help to upgrade our country!) It should be noted that no matter which department the complaints are sent to, they would finally get into the hands of Thilagenthiran a/l Somasundram of DBKL who is in charge of the Damansara area including Brickfields and he would never take any action. What did Thilagenthiran a/l Somasundram do with the complaints? He gave all sorts of stupid excuses and did nothing. Do these stupid excuses imply some fishiness on his part? Bribery or perhaps he has an interest in the restaurant? It seems that we are still living in the cowboy era as lawlessness still prevails today i.e. when our rights are infringed, there isn't any laws to protect us and we have to take the matter into our own hands. It is like being robbed but the police doesn't want to do anything thus leaving it to us to deal with the robber in our own way. Is this what is meant by "Malaysia Boleh"? Now, let us look at the fishy things that Thilagenthiran a/l Somasundram did as well as the fishy lies that he told as presented clearly below.

FISHY THING NO 1
One day, after repeated complaints from the residents, the DBKL officers finally went to check on yarl restaurant. However, instead of looking for the real kitchen hood, they simply assumed that the kitchen hood was the speaker inside the restaurant. So, instead of dealing with the kitchen hood, they went on to deal with the speaker and said that there was no noise pollution. Is this stupidity on their part or just a mistake?  Please read the email from Thilagenthiran a/l Somasundram below:

In this email, Thilagenthiran a/l Somasundram said that the speaker was only temporary since according to yarl restaurant's boss, it was intended to attract customers during Deepavali. Sounds ridiculous, isn't it? We are complaining about the kitchen hood but Thilagenthiran a/l Somasundram is dealing with the speaker.  There is no reason why this mistake could be made when the photo of the kitchen hood is so clear in my blog article (I have provided a link to my latest article in this blog in my email to DBKL). The question is why on earth did Thilagenthiran a/l Somasundram focus on the speaker and did not try to look for the kitchen hood at all? Don't tell me that he didn't know that the kitchen hood is at the back of the restaurant when there is a photo of it in my article. This is clear evidence that he is trying to cover up for yarl restaurant. Even a little child knows what yarl restaurant's kitchen hood looks like after seeing the pictures in my blog but Thilagenthiran a/l Somasundram still cannot differentiate between a speaker and a kitchen hood (after reading my email with a link to my blog). Assuming that the kitchen hood was the speaker, his verdict was - no noise pollution.  Seems that this is the only excuse for Thilagenthiran a/l Somasundram to defend yarl restaurant. Even a stupid child could tell you what a kitchen hood is and where yarl restaurant's noisy kitchen hood could be found after reading my blog and seeing the pictures in it. Why is it that Thilagenthiran a/l Somasundram who has so much experience in dealing with noise pollution can't even differentiate between a speaker and a kitchen hood and he doesn't know where it is even after reading the articles in this blog and seeing a photo of yarl restaurant's kitchen hood. There is a saying "With money even the kitchen hood can turn into the speaker". Just how true is it? Well, it is for the Kuala Lumpur City Hall to answer this question. Since Malaysia is known as one of the most corrupt nations, anything can happen here. 
 


FISHY THING NO 2
Next, Thilagenthiran a/l Somasundram came out with the verdict that as long as the source of noise is in your house, there is no noise pollution. Sounds ridiculous, doesn't it? Let us read the email from Thilagenthiran a/l Somasundram below and see how ridiculous it is:

According to this email, yarl restaurant's motor is inside the restaurant and the kitchen hood is facing downwards into the drain. Therefore Thilagenthiran a/l Somasundram is of the opinion that there is no noise pollution even though yarl restaurant's loud and deafening kitchen hood noise can be heard on the 4th floor! Don't you think that this is the most stupid answer  that anyone could give? Does this mean that I can turn on my CD player loudly at the whole day to disturb my neighbours as long as the CD player is in my house? When the neighbours complain, can I tell them that there is no noise pollution because the CD player is in my house? So, my dear readers, it is alright for you to turn on your CD player, TV, and computer speakers loudly as early as 5.20 a.m. and even at midnight to disturb your neighbours because this is not noise pollution according to the Kuala Lumpur City Hall (Thilagenthiran a/l Somasundram is speaking on behalf of the DBKL). Why is it so? Because the CD player, TV, and computer speaker are in your house! Don't you think that this is indeed one of the greatest jokes of the century? Please take note that no matter how loudly we turn on our CD player or television, it can never be as loud as yarl restaurant's thunderous kitchen hood noise! (It is obvious that Thilagenthiran a/l Somasundram is telling lies for yarl restaurant for the second time).



 
This article is edited to add in the above photos of yarl restaurant's open air kitchen which were taken at 7.30 a.m. and 8 a.m. today. (This article was originally posted at 5.58 a.m. this morning)

If you look at the photo of yarl restaurant's kitchen hood above (the thing with the telephone number on it), it is very obvious that it does NOT even touch the ground. Pungent curry vapour can therefore still escape from the bottom of the kitchen hood into the air to pollute the entire neighbourhood. This clearly explains why the entire area around yarl restaurant's open air kitchen is filled with pungent curry vapour. Below are two photos of kitchen hoods belonging to 2 other restaurants in Brickfields. Let us compare these two photos with yarl restaurant's open air kitchen photos in this blog. If you look at the 2 photos below you will understand what is meant by the kitchen hood facing downwards and ended up in the drain as these 2 pictures clearly show. When the kitchen hood merges with the drain, the curry vapour would go inside the drain and hence cannot pollute the air. But yarl restaurant's kitchen hood did not even touch the drain and that's why the pungent curry from its kitchen is constantly polluting the air (Each time we put our clothes out to dry, they are soaked in curry).

Even though this photo is not so clear, you can still see that the kitchen hood actually merges with the drain which is already covered up so that the pungent curry from the kitchen would go into the drain and cannot pollute the air.

But why did Thilagenthiran a/l Somasundram lie that yarl restaurant's kitchen hood is facing downwards into the drain (menghala kebawah kedalam longkang awam)?  There is another saying: With money nothing is impossible! Once again, it is for the DBKL to tell us how true this saying is! What the DBKL should do now is to find out why Thilagenthiran a/l Somasundram is trying to cover up for yarl restaurant.

FISHY THING NO 3
Upon repeated complaints, the DBKL officers finally went to check on yarl restaurant but they chose the day when it was closed (I suppose a DBKL insider must have known that yarl restaurant was closed that day. Is this DBKL insider Thilagenthiran a/l Somasundram?). According Thilagenthiran a/l Somasundram, since the restaurant was closed that day, there was no noise pollution. Yarl restaurant is opened every day so why chose the day when it was closed? Did they do it on purpose? Let us read the email from Thilagenthiran a/l Somasundram below:

According to this email, they went to check on yarl restaurant on 10 February 2014 but it was closed and locked. The kitchen hood was facing downwards and going into the drain and the motor was inside the premises. They were not in operation. Since yarl restaurant was closed that day, their verdict is: No noise pollution. Even a child could sense something fishy here. Why chose the day when yarl restaurant was closed to check on them? If the restaurant was closed on that day, why not try again another day? Is that the way our government departments function or is this solely Thilagenthiran a/l Somasundram's idea? This is a clear indication of something fishy going on. Yarl restaurant is operating 7 days a week and these DBKL fellows chose to check on them on the one day when it was closed and they never bother to go there again assuming that there is no noise pollution. Thilagenthiran a/l Somasundram is obviously telling lies again for the third time. Why did he keep emphasizing that yarl restaurant's kitchen hood ended in the drain when it is obvious that this kitchen hood did not even touch the drain? Fishiness again?

If the DBKL can be so accurate in their predictions i.e. picked on the day when yarl restaurtant was closed to do the inspection when yarl restaurant is opened 7 days a week, why not do lottery consultancy instead? Anyway, what else can the DBKL do if they can't even settle a simple noise pollution case? Apart from trying to cover up for yarl restaurant's air and noise pollution program in a fishy way, there isn't anything else that they can do. What s shame! Malaysia Boleh!

  1. Don't go through those regular complaint channel. Write an official letter (not email) to DBKL, Kementerian Kesihatan and Kementerian Kesejahteraan Bandar, Perumahan Dan Kerajaan Tempatan.

    Make sure you write on that letter "Salinan Kepada" and put the names of the department's top level officer e.g. YBhg. Datuk Hj. Mhd. Amin Nordin bin Abd. Aziz Ketua Pengarah DBKL. If you don't know who is the top level management officer, look at their website or call them to ask for a name.

    Ensure you mail the same letter to him as well. Ensure the letter is short, concise and has all the complaint number that you have made previously and state clearly no action has been taken.

    Lastly, be persistent. Mail the same letter to them and emphasize that there is no action taken so far. If necessary, visit their office and ask to personally hand the letter to the top level officer.

    I had the same experience as you once and I did the exact same thing to a car-wash operator near my place once. Took them quite a while but it closed down eventually despite there is a lot of business at the car wash.
